Role Overview
SanlamAllianz General Insurance (Kenya) Limited is seeking a Legal Officer to join our Legal Claims team. Based in Nairobi, this full-time on-site role reports to the Assistant Manager - Legal Claims. The primary purpose of this position is to effectively and efficiently investigate, evaluate, and settle insurance or legal claims while ensuring legal compliance with frameworks like the Insurance Regulatory Authority (IRA) and Data Protection Act (DPA). You will be responsible for mitigating financial risk, managing litigated files, analyzing claim merits, and facilitating cost-effective settlements.
Key Responsibilities
- Claim Identification and Analysis: Identify valid claims by analyzing supporting documents and ensuring sufficient evidence is provided by claimants.
- Negotiations: Negotiate legal claims to reduce costs and prepare detailed file notes.
- Fraud Detection: Actively identify and report fraudulent or suspicious claim activities to the Legal Claims Manager.
- Litigation Management: Coordinate with advocates and witnesses to ensure court attendance; ensure timely conclusion of matters and send out hearing notices for active court cases.
- Reporting and Compliance: Submit claims reports on time and follow up with providers (counsel, brokers, agents) according to agreed Service Level Agreements (SLAs).
- Judgment Settlement: Ensure timely settlement of judgments to prevent execution by auctioneers and avoid additional costs.
- Stakeholder Liaison: Act as a point of contact for external counsel, brokers, agents, and direct clients to resolve claims.
- Legal Research: Conduct extensive legal research and write opinions on claims relating to employer's liability, product liability, and personal auto lines.
- Risk Management: Negotiate with Third Party Advocates on out-of-court settlements to save operational costs and minimize risks.
- Reserving: Ensure all assigned legal claims are adequately reserved according to the company's Reserving policy.
- Technical Support: Provide troubleshooting and resolution support for litigation system issues for adjusters and lawyers.
Qualifications and Experience
- Education: Bachelor of Laws (LLB) degree from a recognized university.
- Certification: Postgraduate Diploma in Law from the Kenya School of Law (KSL).
- Experience: A minimum of 2-3 years' relevant legal experience, specifically within the Claims or Legal function of a reputable insurance company.
- Legislation Knowledge: Demonstrated knowledge of Kenyan legislation, litigation procedures, and dispute resolution mechanisms.
- Regulatory Knowledge: Working knowledge of IRA regulations and AKI guidelines applicable to the Kenyan insurance sector.
- Technical Skills: Proven ability to conduct legal research and interpret statutes, regulations, and case law.
- Soft Skills: Strong organizational skills, professional integrity, sound judgment, and excellent communication (written and verbal) for drafting legal opinions and reports.
